Booking Terms & Conditions; J & A Sailing

How to Book
To ensure availability of the desired event for the dates you require, please contact J & A Sailing directly where confirmation will become manual. If booking through Viator where confirmation will be automatic, you must abide by their terms and conditions.  You can then make a deposit payment of 25% of the charter/event fee. The final balance should be paid at least 10 days before the charter/event start date. If you fail to pay the final payment on time J& A Sailing reserves the right to cancel your charter/event, with no refund of deposit. Should you book less than 10 days before your charter/event, then you must pay the full amount at the time of booking.

1. Your Contract
The following terms and conditions will be incorporated into every contract between you and

J & A Sailing. By making a deposit payment you will be accepting the terms and conditions for all members of your party, and you are therefore advised to read them carefully. This contract will be construed in accordance with English Law, and it is agreed by us that each will submit to the jurisdiction of the UK courts.

2. Cancellation
J & A Sailing reserves the right to cancel the booking at any time and the refund will be limited to monies already paid. If you wish to cancel your charter/event, this must be done in writing via email and will be effective from the date that it is received by J & A Sailing. If you cancel at least 10 days prior to your charter/event start date you will lose only your deposit. If less than 10 days’ notice of cancellation is given, after the balance has been paid, the full charter/event fee will be forfeited.

3. Amendment
Should you wish to reschedule your charter/event with more than 10 days’ notice we will offer you alternative dates, subject to availability.

4. Gift Vouchers
Gift vouchers are valid for 12 months from the date of purchase and are not transferable.

5. Insurance
J & A Sailing will insure the vessel used against all usual marine risks.  We recommend you take out travel insurance to cover yourself against personal financial loss as a result of flight cancellation or travel delays or healthy care.

6. Smoking Policy
J & A Sailing operates a strict no smoking and no vaping policy whilst on-board.

7. Charter / Event Termination
You must accept responsibility for the proper conduct of yourself and any members of your party. We reserve the right at our absolute discretion, to terminate without further notice, the charter /event of any client who refuses to comply with the instructions or orders of the skipper or authorised J & A sailing staff member. Any behaviour by an individual in our opinion, likely to cause distress, danger or annoyance to fellow crew, staff or any third party or property will be required to leave the charter/event.

8. Intoxication
Clients will not be allowed to partake while considered to be intoxicated in any way and their charter/event will be terminated immediately.  Upon such termination our responsibility for your charter ceases, and J & A Sailing shall not be liable for any extra costs incurred by you.

9. Photography
Frequently J & A Sailing staff photograph our sailing activities, for use in J & A Sailings’ publicity material only. This includes social media. Should you object to photography taking place whilst you are onboard, please let us know in advance.

10. Force Majeure
Neither party shall be liable if prevented from fulfilling any of its obligations by an incident of force majeure including weather conditions, an act of God, strikes, lock out, act of government or any other occurrence beyond their control.

11. Physical Ability
Sailing can be physically demanding at times. Please ensure you have an appropriate level of physical fitness prior to booking a charter. If you have any questions, then please get in touch.

12. Age Restriction
Any persons under the age of 18 must be accompanied by a parent or guardian.

13. Complaints procedure
J & A Sailing has an established complaints procedure that is to be used should the need arise. Contact us for more details.

14. Data Protection
Personal details will be kept and used only in conjunction with J & A Sailing.
